The Committee considered applications for planning permission received by the Head of Development Management and Building Control under the Town and Country Planning Act 1990, and took into account the oral representations made by members of the public and applicants and their agents.

 

The update report of the Head of Development Management and Building Control was noted in accordance with the urgency provisions of Section 100 B (4) of the Local Government Act 1972 to ensure that Members had before them all the relevant facts and information about the planning applications set out in the agenda.

 

The Committee resolved that, in the event of recommendations being amended at the meeting in light of debate, or other representations made by members of the public, applicants or their agents, the task of formalising the wording of conditions and/or reasons for refusal is to be delegated to the Head of Development Management and Building Control.

Subject to the applicant entering into a Unilateral Undertaking (UU) with Heads of Terms listed below, and the conditions, reasons and informatives detailed in the report and update report, planning permission be granted for Application 192307, for demolition of existing car park and structures and construction of a part 5, part 6 storey building comprising thirty-one (31) residential units with associated parking and landscaping (Amended Description).

 

In the event that the UU is not completed within 12 weeks of the date of the Planning Committee the Assistant Director of Development Management and Building Control is hereby authorised to refuse the application. The planning obligations are necessary to make the development acceptable in planning terms.  In the absence of the Section 106 obligation the Council would not be able to ensure that:

·                    The affordable housing is delivered at the tenure specified,

·                    Measures are in place to improve the public highway and public realm,

·                    Measures are in place to promote sustainable travel options such as walking and cycling, and to reduce car use; and

·                    Measures are in place to manage potential adverse impacts from the Construction

 

HEADS OF TERMS

Transport & Highways

-       Section 278 Highways Improvement Works

-       Renewal of the site access and surrounding footways on Sansom Road

-       Disabled parking spaces

 

The following list of S278 works shall be completed prior to occupation

 

·           Renewal of the existing footway on the frontage of the site on Lansdowne Road, Sansom Road and at the turning head of the road

·           Renewal of the access to the car parking opposite the site to current standards

·           Redesign of the public highway on the western frontage of Sansom Road to include the construction of a new footway (minimum 2.2 metre) on Samson Road with a landscaping strip

·           Renewal of rubber speed cushions and replacement with a sinusoidal road hump

·           Construction of a dropped kerb for access into a parking area to be agreed

·           Provision of a dropped kerb for bin collection

·           Renewal of the existing access to current standards for access to the two disabled car parking spaces

·           Renewal of all road markings on both frontages

·           New tree planting on both frontages

·           Changes to street lighting

 

            Sustainable Walking & Cycling

£35,000 towards waking and cycling infrastructure

 

Construction Logistics Plan Monitoring

£1,500 towards CLP monitoring

 

Carbon Offsetting Payment

A carbon offsetting payment of £1,800 per tonne shall be secured

 

Epping Forest Special Area Conservation (SAC) Payment

£100 per unit.  31 x £100 = £3,100

 

Legal Fees

            Payment of the Council’s legal fees for the preparation and completion of the Unilateral Undertaking.

 

Minor Amendments

That authority to be given to the Assistant Director of Development Management and Building Control in consultation with the Council’s Legal Services for the sealing of the Unilateral Undertaking and to agree any minor amendments to the conditions or the Unilateral Undertaking on the terms set out above.

That contrary to the recommendation contained in the report, planning permission be refused for Application 191016 for construction of 2 x 4-bedroom houses consisting of two storeys with basement level on the land at the rear of 69 Browning Road. Associated refuse storage and landscaping together with the installation of access gate from street, for the following reasons:

 

1.     The proposed development, by reason of the proposed height and design, would be out of keeping with the prevailing character of development within the surrounding area and as such would have harmful impact upon the visual amenity of the surrounding area; and the amenity of the neighbouring residents. The proposed development would, therefore, be contrary to policies CS13 of the Waltham Forest Local Plan Core Strategy (2012) and Policy DM32 of the Waltham Forest Local Plan Development Management Policies (2013). .

2.     The proposed development, by reason of the extent of basement excavation and lack of information submitted regarding surface water and flooding, would have a detrimental impact on the local biodiversity and ecology, and as such fails to demonstrate compliance with Policy CS5 of the Core Strategy Policies Local Plan (2012) and Policies DM34 and DM35 of the Development Management Policies Local Plan (2013).

3.     Due to the site’s location and the access arrangements to the proposed dwellings it has not been adequately established that the site can adequately provide suitable access and equipment for firefighting for the fire services. The proposed development would therefore be contrary to Policy D11 of the draft London Plan 2019, CS15 of the Waltham Forest Local Plan Core Strategy (2012) and Policy DM29 of the Waltham Forest Local Plan Development Management Policies (2013).
