INFORMATION ITEM: PRE-APPLICATION: 58-59 HYLANDS ROAD, E17

Minutes:

The Committee received a presentation by the developer for a proposed scheme at 59-59 Hylands Road, Walthamstow, E17. The Committee were reminded that the scheme is currently at pre-application stage and a formal application for planning permission had not yet been made. 

 

The Committee asked questions about amenity space, the tenure of the disabled units and the adaptability of those units; the parking spaces allocated for disabled parking and sustainability.

The Committee considered applications for planning permission received by the Head of Development Management and Building Control under the Town and Country Planning Act 1990, and took into account the oral representations made by members of the public and applicants and their agents.  

 

The update report of the Head of Development Management and Building Control was noted in accordance with the urgency provisions of Section 100 B (4) of the Local Government Act 1972 to ensure that Members had before them all the relevant facts and information about the planning applications set out in the agenda.  

 

The Committee resolved that, in the event of recommendations being amended at the meeting in light of debate, or other representations made by members of the public, applicants or their agents, the task of formalising the wording of conditions and/or reasons for refusal is to be delegated to the Head of Development Management and Building Control.

·         expressed concern about refuse disposal and delegated authority to the Head of Development Management and Building Control to obtain further information on refuse management and, if necessary, to amend condition 14 to require the submission and approval of a refuse management plan. 

·         expressed concern about access to the site and asked officers to consider this further before issuing the planning permission

 

Resolved:

 

That planning permission be granted, subject to further consideration being given to refuse management and access, for the reasons detailed in the committee report for application 183813 for construction of 2 x 2-bedroom houses with rooms in roof space and front and rear dormers following demolition of existing single storey dwelling.

Subject to the applicant entering into a Unilateral Undertaking (UU) for the purposes set out below, and the conditions, reasons and informatives detailed in the report, planning permission be granted for Application 191378, for demolition of single storey rear additions and side extension to No.18 & 16 in connection with conversion of building to 2 x 4-bedroom dwelling houses (Class C3). Construction of single storey rear extensions with lantern roof lights. Alterations to fenestration in all elevations and installation of two roof lights to main rear roof slope. Replacement of main roof tiles and new entrance canopy to side elevations. Installation of new front boundary wall with timber gate to each proposed access. Hard and soft landscaping and associated refuse storage.

 

Heads of Terms:

·           Highways: Car free development – Residents will not be eligible for a parking permit for any surrounding CPZ.

·           Legal Fees: Payment of the Council’s legal fees for the preparation and completion of the Legal Agreement.

That authority to be given to the Head of Development Management and Building Control in consultation with the Council’s Legal Services for the sealing of the UU and to agree any minor amendments to the conditions or the UU on the terms set out above.

In the event that the UU is not completed within 12 weeks following the date of Planning Committee, the Head of Development Management and Building Control is hereby authorised to refuse the application. In the absence of this UU, the proposed development would not be able to deliver the residential development on the site.
