The Committee considered applications for planning permission received by the Head of Development Management and Building Control under the Town and Country Planning Act 1990, and took into account the oral representations made by members of the public and applicants and their agents.

 

The update report of the Head of Development Management and Building Control was noted in accordance with the urgency provisions of Section 100 B (4) of the Local Government Act 1972 to ensure that Members had before them all the relevant facts and information about the planning applications set out in the agenda.

 

The Committee resolved that, in the event of recommendations being amended at the meeting in light of debate, or other representations made by members of the public, applicants or their agents, the task of formalising the wording of conditions and/or reasons for refusal is to be delegated to the Head of Development Management and Building Control.

That planning permission be granted, for the reasons detailed in the committee report and update report, for application 183424 for demolition of existing buildings and structures, and comprehensive redevelopment to provide a series of buildings ranging in height from 1 to 15 storeys to provide 359 new affordable homes in a mix of one, two and three bedroom units (Use Class C3) 2,569sqm of non-residential floor space comprising of 720sqm of flexible floor space (Use Class A1 and/or A2 and/or A3 and/or A4 and /or B1 and /or D1 and/or D2), 532sqm of flexible floor space (Use Class B1 and/or D1) and 1,313sqm of floor space (Use Class B1), car parking, cycle parking, landscaping, highways and utilities works subject to Stage 2 Referral to the Greater London Authority (GLA) and completion of a Section 106 Agreement with the Heads of Terms set out below and negotiations taking place between the Head of Development Management and Building Control and the developer to achieve a balanced mix  of one, two and three bedroom wheelchair adaptable units spread across the scheme and appropriate disabled parking for those units.

 

Heads of Terms: 

Affordable Housing Provision:

·                    To secure 100% affordable housing by unit numbers delivering 359 units (137 x one-bed, 169 x two-bed, 53 x three-bed) with a tenure arrangement of 100% intermediate shared ownership.

 

Employment and Training Strategy:

·                    The employment and training package to include employment, apprenticeships and work placements for borough residents shall be submitted to and agreed by the Local Planning Authority. Where the terms of this Agreement are not met, payments in lieu would be accepted on the following basis;

 

o   Where work placements are not provided – 16 x £3,234 = £51,744

o   Where borough residents are not employed as part of the construction of the development – a contribution not exceeding £851,789.64 (30% of 3% of the total Build Cost).

           

Retail and Commercial Space Strategy:

·                    A Retail and Commercial Space Strategy to be submitted to and approved in writing by the Local Planning Authority at least six months prior to occupation of any part of the commercial element that would seek to ensure diversity in the local offer.

Highways:

·                    Highways financial contribution of £150,000 is confirmed towards sustainable transport and walking, cycling safety and accessibility improvements

·                    A financial contribution of £33,000 towards flooding and drainage inspections post-construction over a 30-year period.

·                    Section 278 Agreement for works on the western frontage to provide a stepped cycle track in each direction on Blackhorse Lane, works to the culvert under Blackhorse Lane / public highways and works to the eastern frontage at Sutherland Road.

·                    Section 38 adoption of a slither of land on the eastern footway between the existing red line boundary and the colonnade.

·                    Car-Free Development: The development would be car-free, with the exception of the provision of wheelchair accessible bays. Residents would not be eligible to apply for a resident permit for any CPZ.
