Application for Premises Licence under the Gambling Act 2005.

Minutes:

On 12 December 2013 at 10.00 am, the Gambling Act Sub-Committee heard an application made on behalf of William Hill for a Premises Licence under Section 159 of the Gambling Act 2005.  Councillor Falconer was appointed Chair. 

 

The Applicant was represented by Richard Taylor, Gosschalks Solicitors. 

The Council as Licensing Authority was represented by Marc Witham. The Responsible Authority making a representation was: David King on behalf of the Licensing Service and Councillor Saima Mahmud Ward Councillor who made a representation.

 

There were oral presentations as follows:

  • David King for the Licensing Service as Responsible Authority;
  • Richard Taylor Gosschalks Solicitors,  for the Applicant;
  • Marc Witham for the Council as Licensing Authority;
  • Councillor Saima Mahmud Ward Councillor who made a representation.

 

The Sub-Committee, the Applicant, the Responsible Authority and the Interested Party were all able to raise questions after each presentation.

 

The Sub Committee then went on to consider the Application in closed session. It then recalled all parties and announced its decision to REJECT the application by the Applicants for a premises licence.

 

The Sub Committee took the following into account when reaching its decision:

  • The Committee Report and its appendices;
  • The brochure submitted by the Applicant ahead of the hearing
  • Oral representations and questions and answers of the parties listed above;

 

The Sub-Committee also considered the provisions of the Gambling Act 2005, in particular, the provisions of S153, the guidance and relevant code of practice issued by the Gambling Commission, the licensing objectives, in particular, preventing gambling from being a source of crime or disorder, being associated with crime or disorder or being used to support crime, and the Council’s Statement of Principles.

 

The sub-committee noted that the general presumption under s 153 is to grant a licence, however, there are currently five betting premises within a 0.5 mile radius of the premises

 

The Sub-Committee also noted that the premises was situated within the Hoe Street, Cumulative Impact Policy area which was implemented due to high levels of alcohol related crime and anti-social behaviour in the High Street/Hoe Street area The committee were concerned that Hoe Street ward has the third highest level of recorded crime in the Borough; and Chapel End ward is one of 3 priority locations chosen by the locations board based on overall crime and the ‘cost’ of those crimes compared to other wards.
