Minutes:

Councillor Liz Phillips stated that in regard to agenda item 4.2, 2012/0028: Colegrave Arms Public House, 145 Cann Hall Road, E11, she had attended a public meeting where the site had been discussed, but she had not spoken on the matter and retained an open mind.

 

Councillor Alan Siggers informed the Committee that he had been lobbied in regard to agenda item 4.1, Application 2012/0200: 90 Chingford Mount Road, E4, but stated that he had not expressed a view on the matter.  Councillor Siggers then declared a non-pecuniary interest in agenda item 4.7, Application 2012/0820: 24 Grange Park Road, E10, for the reason that a number of years ago, before becoming a councillor for the London Borough of Waltham Forest, he had expressed an opinion in regard to the building that currently occupied the site. With regard to the common law of bias and predetermination Councillor Siggers left the room during consideration of this item.

The Committee considered applications for planning permission received by the Head of Development Management and Building Control under the Town and Country Planning Act 1990 and took into account the oral representations made by members of the public and applicants and their agents.

 

The Committee noted that its Chair had agreed to the submission of the Update Report of the Head of Development Management and Building Control at the meeting in accordance with the urgency provisions of Section 100 (B) (4) of the Local Government Act 1972 to ensure that Members had before them all the relevant facts and information about the planning applications set out on the agenda.

 

The Committee resolved that, in the event of officer recommendations on the planning applications being amended at Committee in the light of debate and other representations made, the task of formalising the wording of conditions and/or reasons for refusal be delegated to the Head of Development Management and Building Control along the broad lines indicated at the meeting. Details of the Applications and the Committee’s decisions are set out in these minutes.

Application 2012/0200: 90 Chingford Mount Road, Chingford, E4 pdf icon PDF 77 KB

Minutes:

Planning permission refused for Application 2012/0200 for change of use of ground floor to cultural centre, place of worship, educational facility and meeting room linked to No. 92 by removal of internal wall, single storey rear extension and alteration to shopfront in line with the reasons and recommendations set out in the report.

 

Reasons for refusal

 

1.     The proposals would result in a further intensification of the existing use resulting in serious detriment to nearby residential occupiers in terms of increased noise and disturbance especially at unsociable hours, increased traffic generation and disturbance from an increase in general activity in the wider area. The proposals would be contrary to policy CS15 and CS13 of the adopted Waltham Forest Core Strategy 2012.

 

2.     The proposals would result in an increase in traffic generation and resulting congestion within the residential roads close to the site and would impact upon the free flow of traffic on Chingford Mount Road to the detriment of local amenity and highway and pedestrian safety. The proposals would be contrary to policy CS15, CS13 and CS7 of the adopted Waltham Forest Core Strategy 2012.

 

3.     The proposals would result in an increase in demand for on street parking in an area which is already heavily parked and has little spare capacity. This would be to the detriment of the amenity of local residential occupiers. The proposals would be contrary to policies CS13, CS15 and CS7 of the adopted Waltham Forest Core Strategy 2012.

Application 2o12/0028: Colegrave Arms Public House, 145 Cann Hall Road, Leytonstone, E11 pdf icon PDF 104 KB

Minutes:

Subject to the applicant entering into a Section 106 Legal Agreement with the Council for the purposes set out below, planning permission granted for Application 2012/0028, in line with the recommendation, conditions, reasons and informatives set out in the main report, and the update report, for change of use from public house (use class A4) to mosque (use class D1), along with the4 provision of 2-bedroom self-contained flat on the second floor.

 

Section 106 Legal Agreement

 

a)    A contribution of £10,000 towards public realm improvements in Cann Hall Road;

b)    A Travel Plan shall be prepared with special regard to the use and promotion of the approved minibus and cycling facilities and this shall be submitted to the Local Planning Authority with the agreed details and recommendations implemented prior to the commencement of use and adhered to for the duration of the use;

c)     Payment of the Council’s legal fees for the preparation of the s106 Agreement; and

d)    Payment of 5% of the total amount of s106 contributions to London Borough of Waltham Forest for the monitoring of and compliance with this agreement.

Application 2011/1560: Leyton Marsh, Behind Lee Valley Ice Centre, Lea Bridge Road, E10 pdf icon PDF 106 KB

Minutes:

That in regard to planning application 2011/1560 (site reinstatement post-Olympic and Paralympic) details are agreed, in principal, in line with the recommendation, conditions, reasons and informatives set out in the main report, and the update report, for discharge of Condition 1 of planning application 2011/1560, as follows:

 

a)    Option 3 involving the installation of the thick roll turf (40mm), the proposed seed mix on the short mown turf and rough grassland (which is compatible with the surrounding marsh land).  The details of the sub-base and location of the membrane will be dealt with by Officers under delegated powers.

 

b)    That the applicant is advised that this decision only partially agrees the details, and that further details of the sub-base and location of the membrane must be submitted to, and approved by, the Local Planning Authority prior to its installation.

Application 2011/0275: Car Park Opposite Dog Stadium, 457 Chingford Road, Chingford, E4 pdf icon PDF 153 KB

Minutes:

Subject to the applicant entering into a Section 106 Legal Agreement with the Council for the purposes set out below, and referral to the Greater London Authority, planning permission granted for Application 2011/0275, in line with the recommendation, conditions, reasons and informatives set out in the report, for erection of vehicle showroom, retail parts distribution centre, vehicle workshops and valet servicing/MOT facilities with associated landscaping, new access from Walthamstow Avenue and closure of access opposite Empress Avenue.

 

Section 106 Legal Agreement

 

(a)  A contribution of £21,340 for Council’s Air Quality Management Scheme.

(b)  A contribution of £35,500 for Highway and Transport improvements within the locality.

(c)  A s278 Highways agreement be entered relating to contributions of £44,000 for highway improvement works incorporating:

(i)      Creation of new access

(ii)     Stopping up of redundant accesses, no longer required as part of the development.

(iii)   New lighting design in Walthamstow Avenue, from junction of Chingford Road to mini roundabout

(iv)   Renewal of footpaths on both frontages of site up to the mini roundabout in Walthamstow Avenue.

d)  The developer undertaking to pay all costs arising from any statutory undertaker’s diversion works required as part of the development and the cost of road safety audits before and after construction of the highway works in b) above.

 e) Adoption and full implementation of agreed Workplace Travel Plan submitted 7th August 2012, in support of sustainable means of travel.

 f)  The provision of employment and training opportunities for residents of Waltham Forest.

g)  Payment of an additional 5% of the financial contributions as a monitoring charge for the Council to monitor the implementation of the legal agreement.

Subject to the applicant entering into a Section 106 Legal Agreement with the Council for the purposes set out below, planning permission granted for Application 2012/0807, in line with the recommendation, conditions, reasons and informatives set out in the main report, and the update report, for demolition of existing buildings and erection of terrace of 6 x two storey houses (1x 2 bed 5x3 bed) with vehicle access from Church Lane and pedestrian access from Shernhall Street E17.

 

Section 106 Legal Agreement

 

(a)  A contribution of £32,502 towards primary and secondary education provision.

 

(b)  A contribution of £11,094 towards health care provision.

 

(c)  A charge of 5% of the above amount as an administration fee for monitoring of the agreement.

 

(d)  That the developer enters into an appropriate agreement with the Council as Local Highway Authority to meet the cost of the replacement of the dropped kerb to the frontage of 54 Shernhall Street.

Minutes:

Planning permission refused for Application 2012/0820, for the demolition of the existing doctors surgery and erection of a three storey building including a lower ground level to form four flats (3 x 2 bed and 1 x 1 bed), in line with the recommendation, reasons and informatives set out in the report.

 

Reasons for refusal

 

1.   The proposed development would have features out of character within the area that are not sympathetic to and would not harmonise with the existing pattern of development contrary to policies CS2, CS13 and CS15 of the Waltham Forest Local Plan – Core Strategy (2012) and Supplementary Planning Document – Urban Design (2010) and Supplementary Planning Document – Residential Extensions and Alterations (2010). 

2.  The proposed development would have a significant adverse effect on neighbour amenities from loss of outlook and light, sense of enclosure and visual impact of bulk from the depth and location of the main building and rear projection, and over-looking and lack of privacy from the first floor side balcony  contrary to policies CS2, CS13 and CS15 of the Waltham Forest Local Plan – Core Strategy (2012) and Supplementary Planning Document – Urban Design (2010) and Supplementary Planning Document – Residential Extensions and Alterations (2010). 

3.        Minimum residential standards would not be met as minimum internal dwelling, room space and room dimensions are not provided resulting in a poor standard of amenity to future occupiers contrary to policies CS2, CS13 and CS15 of the Waltham Forest Local Plan – Core Strategy (2012) and Supplementary Planning Document – Urban Design (2010) and Supplementary Planning Document – Residential Extensions and Alterations (2010). 

4.        The proposed scheme does not provide access for all as ramping is inadequate and Lifetime Homes standards are not met contrary to policies CS2, CS13 and CS15 of the Waltham Forest Local Plan – Core Strategy (2012) and Supplementary Planning Document – Urban Design (2010) and Supplementary Planning Document – Residential Extensions and Alterations (2010). 

5.        The development fails to have sufficient regard to Secure by Design requirements creating a ‘dead’ frontage to the main street elevation creating severely insecure front garden without ownership, entrance to the building or through access, unused and with a sub-basement area obscured from public view providing an inappropriate insecure area with no informal surveillance contrary to policies  CS2, CS13, CS15 and CS16 of the Waltham Forest Local Plan – Core Strategy (2012) and Supplementary Planning Document – Urban Design (2010) and Supplementary Planning Document – Residential Extensions and Alterations (2010). 

6.        Suitable tree protection has not been provided to ensure that existing trees in the vicinity of the development are properly safeguarded contrary to policies CS5, CS13 and CS15 of the Waltham Forest Local Plan – Core Strategy (2012).
