Minutes:

The Committee considered applications for planning permission received by the Head of Development Management and Building Control, under the Town and Country Planning Act 1990, and took into account the oral representations made by members of the public and applicants and their agents.

 

The Committee noted that its Chair had agreed to the submission of the Update Report of the Head of Development Management and Building Control at the meeting in accordance with the urgency provisions of Section 100 (B) (4) of the Local Government Act 1972 to ensure that Members had before them all the relevant facts and information about the planning applications set out on the agenda.

 

The Committee resolved that, in the event of officer recommendations on the planning applications being amended at Committee in the light of debate and other representations made, the task of formalising the wording of conditions and/or reasons for refusal be delegated to the Head of Development Management and Building Control along the broad lines indicated at the meeting.  Details of the applications and the Committee’s decisions are set out in these minutes.

 

Deferred item

68.

Car Park opposite Dog Stadium, 457 Chingford Road, Chingford, E4

Minutes:

In response to a question raised by a member of the Committee, the Council’s Principal Planning and Licensing Solicitor stated that as this application had been deferred from a previous meeting. Councillor Khevyn Limbajee was excluded from taking part in the discussion, or voting thereon, of the item, in accordance with the Council’s Planning Code of Practice.

 

Having been moved and seconded, the officers’ recommendation to approve planning permission was put to the vote, with three members of the Committee voting in favour of the motion to accept the recommendation, and three members voting against.  Consequently the Chair used his casting vote to accept the officers’ recommendation.  Therefore planning permission was granted subject to the applicant entering into a Legal Agreement with the Council for the purposes set out below, and referral to the Greater London Authority, for Application 2011/0278, in line with the reasons, recommendations and informative set out in the main report, and the update report, for use of west side of car park as a coach/bus depot for 64 buses/coaches and 38 mini buses, along with associated plant storage facility, ancillary office and associated landscaping and formation of access from Walthamstow Avenue roundabout.

 

Section 106 Legal Agreement

 

a)    A contribution of £3,939.60 for Council’s Air Quality Management Scheme.

b)    A s278 Highways Agreement be entered relating to contributions of £110,000 for highway improvement works incorporating:

(i)              New lighting design for access and mini roundabout, with lighting design changes impacting on lighting in Walthamstow Avenue.

(ii)             Stopping up of existing site access, no longer required as part of the development.

(iii)            Creation of new access onto roundabout to be constructed.

(iv)           Renewal of footpaths between mini roundabout and vicinity of site.

(v)             Kerb realignment at mini roundabout to widen exit towards Chingford Road. Localised carriageway resurfacing and re-profiling associated with the kerb works.

c)  The developer undertaking to pay all costs arising from any statutory undertaker’s diversion works required as part of the development and the cost of road safety audits before and after construction of the highway works in b) above.

d) Adoption of a Workplace Travel Plan, which would be submitted to and approved in writing by the Local Planning Authority in support of sustainable means of travel.

e) The provision of employment and training opportunities for residents of Waltham Forest.

f)   Payment of an additional 5% of the financial contributions as a monitoring charge for the Council to monitor the implementation of the legal agreement.

681.

Land at Billet Works, Kimberley Industrial Estate & Tyco Works, Billet Road, Walthamstow, E17 pdf icon PDF 409 KB

Minutes:

Subject to the applicant entering into a Legal Agreement with the Council for the purposes set out below, and referral to the Greater London Authority, planning permission granted for Application 2011/0898, in line with the recommendation, conditions, reasons and informatives set out in the main report, and the update report, for a mixed-use development involving demolition of existing buildings and construction of 344 residential units (37 x 1 bed, 128 x 2 bed, 142 x 3 bed, 37 x 4 bed) in new buildings ranging from two to five storeys in height. Also comprising retail floor space (Use Class A1 – A3, total comprising 787m2), Office floor space (Use Class B1, 1,119m2), community space and crèche (Use Class D1, 496m2), a total of 293 car parking spaces (under croft and surface), 696 cycle spaces, new and modified vehicular and pedestrian access points from Billet Road and Kimberley Road, provision of amenity open space, including a linear park and associated landscaping, installation of plant and servicing.

 

Section 106 Legal Agreement

 

a)    Provision of a minimum of 50 units of affordable housing (15% by unit numbers) grant free to a mix in line with the Council’s adopted Housing Strategy and the planning strategy for the area, at rents in line with the Council’s Affordable Rent Guidance with any variation to the tenure mix to be subject to written approval from the local authority.

 

b)    The level of affordable housing to be subject to viability reassessment, based on a Residual Land Value approach, undertaken on a phased basis to reflect scheme phases and outturns.

 

c)     The applicant to provide detailed evidence on an open book basis at the point of completion, or close to completion of each phase, to determine whether a higher level of affordable housing and/or increased Section 106 financial contributions can be provided.

 

d)    A number of market sale units to be identified that can be flipped to affordable housing units should the viability re-assessments demonstrate that scheme viability has improved.

 

e)    A restriction on occupation to be applied to an appropriate number of market sale units to reflect the policy shortfall.

 

f)      The first tranche sales of shared ownership units to be at a level that is affordable to persons on the Homebuy Agent waiting list for the borough, to be marketed with first tranche sales at a minimum of 25% and a maximum of 40% for an 8 week period and tenancy lengths for the affordable rented units to be agreed and approved in writing by the local authority.

 

g)    The timing/phasing of the provision of all housing to be agreed including the timing/phasing of the affordable housing in relation to the market housing and provision of the non-residential uses including the community space, retail and business floor space.
